Is HHC Legal in Minnesota?

The issue here is that the legality of HHC in Minnesota just isn’t very clear. As you will see below, according to the 2018 Farm Bill on a federal level HHC should be legal. Therefore, if we were simply talking about the federal government, yes, HHC should be legal in Minnesota.

However, when it comes to the Minnesota State legislature, this issue is somewhat unclear, and the reason for it is that the State legislature has never addressed HHC directly. The Minnesota State legislature has, however, started proposing new bills to differentiate between various cannabinoids. 

It does need to be said, that according to Minnesota law Delta-8 THC, even though it is derived from the hemp plant (which should be legal according to the 2018 Farm Bill), is still considered a drug and is illegal.

Based on this, it would be safe to assume that once proposed legislation is passed HHC would also be labeled as illegal. However, at this time, Minnesota state law has not addressed HHC, so it is in limbo. Federally, HHC is legal, but at a Minnesota state level, its legality is questionable. At the time of writing,  HHC and THC-O are also explicitly banned; with only delta-8 and delta-9 THC derived from hemp being allowed.

This is also unclear. Once again, federally, according to the 2018 Farm Bill, HHC (which is hemp-derived) should be legal. However, it would appear that the statutory definition of hemp only applies to leafy materials, not to extracts, which is what HHC gummies would be made out of.

Once again, HHC has not been addressed by Minnesota state law, so it sits in legal limbo, and at this time, you can assume that it is legal, or at least not illegal, at least not until the State decides to address HHC specifically. As Delta-8 is considered an illegal drug in Minnesota, one could assume that once the Minnesota legislature does address HHC, it would be classified as illegal.

 

HHC THC Federal Laws

As far as federal laws are concerned, HHC should be legal on a federal level. The 2018 Farm Bill states that any cannabinoid derived from a hemp plant that contains less than 0.3% THC, Delta-9 THC, is legal, which is why CBD is legal at a federal level. Seeing as HHC is derived from hemp plants that contain less than 0.3% THC, HHC should be legal at a federal level. That being said, the federal legislature has never addressed HHC directly either.

 

Minnesota Law Regarding HHC

Cannabinoids that are synthetic or derived artificially (excluding delta-8 or delta-9 THC) are not allowed. Prohibited substances also include THC-P, THC-O, and HHC.
